The "Fair Use" Exemption

Section 107 of the 1976 Copyright Act outlines the rather precise criteria necessary for the reproduction without permission or fee payment of a copyright protected work. "Fair Use" almost always exists in an educational context -- but be warned: court decisions appear to be giving increasing weight to the fourth criterion -- impact on the market value of the protected work. Recently, the "Fair Use" exemption has become a focus of controversy in the post-DMCA environment -- see Siva Vaidhyanathan's "Copyright as Cudgel" from the online Chronicle of Higher Education.


Guidelines for Copying for Educational Purposes

Guidelines are just that -- useful suggestions that, while helpful, do *not* have the force of law. The "safe harbors" that these guidelines suggest may -- or may not -- be recognized by any given court. Follow these guidelines with some confidence, but not total assurance.
